| Summary, etc. | The Development of Generative Artificial Intelligence from a Copyright Perspective examina los desafíos legales que plantea el uso de obras protegidas por derechos de autor en los procesos de entrenamiento y generación de contenido mediante inteligencia artificial generativa. Se parte de la creciente preocupación por la compatibilidad de estas tecnologías con la normativa europea e internacional de propiedad intelectual.<br/><br/>A lo largo del documento se analizan los fundamentos jurídicos más relevantes, como las excepciones para minería de texto y datos, las licencias de uso y el posible carácter infractor de ciertos usos automatizados de contenido protegido. También se abordan las limitaciones actuales de los marcos legales existentes, así como el papel de los titulares de derechos, plataformas tecnológicas y desarrolladores de modelos de IA. Se identifican áreas de incertidumbre jurídica que afectan tanto al desarrollo como a la explotación comercial de sistemas generativos.<br/><br/>Como medida estratégica, se plantea la necesidad de adaptar el derecho de autor a la nueva realidad tecnológica, mediante mayor claridad normativa, incentivos a la transparencia en los modelos y el equilibrio entre innovación y respeto a los derechos culturales. El documento propone un diálogo estructurado entre legisladores, industria y sociedad civil para construir soluciones sostenibles. |
