Analiza las obligaciones positivas del Estado en la prevención de la violencia de género y estudia si la responsabilidad patrimonial de la Administración puede aplicarse cuando una valoración incorrecta contribuye a la producción de un daño. La investigación utiliza la teoría de la pérdida de oportunidad y propone un método para estimar la probabilidad atribuible a la actuación administrativa. También plantea considerar la diligencia emitida por VioGén como acto administrativo para facilitar su impugnación antes de que el daño llegue a producirse. |
