A partir de la sentencia del Tribunal Supremo de 11 de septiembre de 2025 sobre el caso BOSCO, examina los argumentos de opacidad basados en propiedad intelectual y seguridad nacional. El autor sostiene que el acceso al código fuente, siempre que sea posible, constituye una garantía del Estado de Derecho y analiza las limitaciones del marco vigente, incluido el Reglamento de Inteligencia Artificial, para consolidar un debido proceso tecnológico. |
